Development
of your shoreline property is regulated
by the following Conservation Law:
Coastal Erosion Hazard Areas: ECL
Article 34; NYS-DEC 6 NYCRR 505
Land use, development, and other activities
are regulated in areas of the coast affected
by serious erosion or acting as natural
erosion control features (such as beaches,
barrier bars, or sand dunes). Construction
of new structures is permitted only if
the structure is placed a safe distance
back from an area of active erosion or
if the structure is movable. Construction
of erosion control structures is regulated
to ensure that they will work as intended,
will last a reasonable length of time,
and will not cause an increase in or
shifting of erosion to adjacent properties.
This law can be implemented by either
local governments or by NYSDEC, so applicants
should check with local officials or
NYSDEC to determine jurisdiction for
any specific area.
